These Terms of Use ("Terms") govern your access to and use of Plan Checker, a trading name of Elegance Engineering Ltd. ("Plan Checker," "we," "us," or "our"). By accessing or using our website, mobile application, or related services (collectively, the "Platform"), you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms apply to all users of the Platform, including registered professionals, clients, and visitors ("Users"). For verification details, please see our Professional Verification Policy. For content rules, please see our Content Guidelines and Standards.
By creating an account, accessing, or using the Platform, you agree to these Terms, our Privacy Policy, Cookie Policy, Fees Agreement, and related policies.
You must be at least 18 years old.
You must have legal authority to enter binding agreements. If using on behalf of an entity, you confirm you have authority to bind it.
The Platform is intended for UK use and governed by UK law. Users outside the UK use it at their own risk.
You must provide accurate information and keep it up to date.
You are responsible for your login credentials and all activity under your account.
Accounts cannot be transferred or sold without our consent.
Notify us immediately of any unauthorized use.
We may suspend or terminate accounts suspected of fraudulent, abusive, or unlawful use.
Plan Checker verifies only that Registered Building Inspectors are listed on the official Register of Building Inspectors at the correct class.
The Platform may only be used for lawful purposes.
You must not engage in unlawful, harmful, or disruptive activity (malware, hacking, spam, defamatory content, etc.).
Professionals are solely responsible for ensuring compliance with all laws, regulations, insurance, CPD, and qualifications relevant to their services. Plan Checker does not check or enforce these requirements beyond verifying RBI registration on the public register.
You are responsible for your posted content. By uploading, you grant us a non-exclusive license to use and display it for platform purposes.
We may remove content that violates these Terms, our Content Guidelines, or the Online Safety Act 2023.
We aim to comply with WCAG 2.1 AA and the Equality Act 2010.
Service, subscription, or transaction fees are set out in the Fees Agreement.
Payments are processed by third-party providers (e.g., Stripe). We do not hold client funds.
Users must not avoid platform fees.
Refunds follow our Cancellation and Refund Policy and Stripe processing terms.
Users are responsible for their own tax obligations.
Fees may change with notice.
Plan Checker is not a party to contracts formed between clients and professionals.
Users must resolve disputes directly, though Plan Checker may offer non-binding assistance.
Plan Checker does not guarantee quality, legality, or accuracy of services. Verification is limited to confirming RBI registration on the official register.
Users must perform their own checks before engaging others.
Consumers may be entitled to refer disputes to an ADR provider under UK regulations.
All platform content belongs to Plan Checker or licensors.
You may not copy or modify without consent.
Feedback may be used freely by us.
We process personal data under our Privacy Policy in line with UK GDPR and the Data Protection Act 2018.
You may close your account at any time. We may suspend or terminate accounts that breach these Terms.
The Platform is provided "as is."
We are not liable for indirect or consequential losses.
Nothing excludes liability for fraud, death, or injury caused by negligence.
Our liability is limited under the Digital Markets, Competition and Consumers Act 2023 and the Online Safety Act 2023.
These Terms are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of English courts, unless resolved informally or via ADR.
Consumer rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 are unaffected.
We may update these Terms periodically. Updates take effect upon posting with a new "Effective Date."
